Construction and Building Materials Branch

The Construction and Building Materials Branch of the Environmental Permits Division (EPD) is responsible for processing applications for environmental permits and coverages for facilities that conduct Construction or Building Material related activities based on the applicant's Standard Industrial Classification (SIC) Code.

Specific permits and coverages handled by this branch include Air Construction, Air Operating, Air Title V, Water NPDES, Water Pretreatment, Water State Operating, Multimedia Asphalt Coverage, Water Baseline Industrial Stormwater Coverage, Water Construction Stormwater Coverage, Water Ready Mix Coverage.

The Mississippi Department of Environmental Quality proposes to reissue the statewide Small Construction General Permit (MSR15). This permit, originally issued in March of 2003, covers the State of Mississippi and authorizes the discharge of treated/managed storm water runoff into the waters of the State. This permit covers construction activities, including clearing, grading, and excavating, that disturb one (1) acre to less than five (5) acres. Small construction activities disturbing less than one (1) acre are designated if the project is part of a larger common plan of development or sale with a planned disturbance of equal to or greater than one (1) acre but less than five (5). This reissuance will allow the continued discharge of treated/managed storm water for an additional five-year period. This general permit will replace the previous general permit that expired on December 31, 2012. The Small Construction General Permit Public Notice Draft can be accessed here. MDEQ will follow the federal storm water regulations as they apply to oil and gas-related construction activities. Construction activities associated with oil and gas exploration, production, processing and treatment, and transmission facilities that are defined in the following North American Industrial Classification System (NAICS) codes and titles: 211-Oil and Gas Extraction, 213111-Drilling Oil and Gas Wells, 213112-Support Activities for Oil and Gas Operations, 48611-Pipeline Transportation of Crude Oil and 48621-Pipeline Transportation of Natural Gas, are generally exempt from State NPDES construction requirements. MDEQ strongly encourages voluntary application of construction best management practices in order to minimize the discharge of pollutants in storm water runoff. On December 14, 1999, the Hot Mix Asphalt Plant General Permit was issued that authorizes the discharge of storm water associated with industrial and construction related activities and the construction and operation of air emissions equipment. Asphalt Notice of Intent in order to obtain a certificate of coverage that establishes the guidelines and standards for conducting the activities described in the general permit.

On May 26, 1998, the Ready Mix Concrete General Permit was issued that authorizes the discharge of waste water and storm water associated with industrial and construction related activities. Applicants must submit the Ready Mix Notice of Intent in order to obtain a certificate of coverage that authorizes the activities outlined in the General Permit and establishes the guidelines and standards for conducting the activities described in the general permit.

MDEQ has added a link to a form entitled "Coastal County Utility Authority Environmental Clearance Form to the Office of Pollution Control" under commonly used applications and forms. This form is required to be completed and submitted to MDEQ for all construction stormwater coverages in Hancock, Harrison, Jackson, Pearl River and Stone Counties.
