ACT8, Condition S-2(3) on Page 17 of the statewide Multimedia Hot Mix Asphalt Facility General Permit (MSR70) has been revised to include stack testing protocol language that existed in the previous General Permit but was omitted in the new General Permit during the recent reissuance process. The added permit language requires the coverage recipient to perform stack testing in accordance with EPA Reference Methods 1-5 (40 CFR 60, Appendix A) and the testing procedures in 40 CFR 60.93. In addition, the coverage recipient shall demonstrate compliance with the opacity limitation in accordance with EPA Reference Method 9 and testing procedures in 40 CFR 60.93 and 40 CFR 60.11. The Permit Board on Environmental Quality reissued the statewide Multimedia Hot Mix Asphalt Facility General Permit (MSR70) on March 2, 2015. This permit authorizes the discharge of storm water run-off into waters of the State and the construction and operation of air emissions equipment from Hot Mix Asphalt facilities in accordance with the provisions of the Mississippi Air and Water Pollution Control Law. This reissuance will allow the continued operation of Hot Mix Asphalt facilities for an additional five-year period. Coverage recipients wishing to be covered under the reissued general permit must submit a Re-coverage Form within 30-days of the date of the Letter of Instruction. Affected Hot Mix Asphalt facilities seeking initial coverage may do so by submitting the appropriate documents found in the Hot Mix Asphalt General Permit Forms Package.

This permit authorizes the discharge of process wastewater and storm water run-off into waters of the State and the construction and operation of air emissions equipment from Ready-Mix concrete facilities in accordance with the provisions of the Mississippi Air and Water Pollution Control Law. This reissuance will allow the continued operation of Ready-Mix Concrete facilities for an additional five-year period. Coverage recipients wishing to be covered under the reissued general permit must submit a Re-coverage Form within 30-days of the date of the Letter of Instruction. The Permit Board on Environmental Quality reissued the statewide Multimedia Ready-Mix Concrete Facility General Permit (MSG11) on April 1, 2009. This permit allows the discharge of process wastewater and storm water run-off into waters of the State and the construction and operation of air emissions equipment from Ready-Mix concrete facilities in accordance with the provisions of the Mississippi Air and Water Pollution Control Law. This general permit will be active for a five-year period.

MDEQ will follow the federal storm water regulations as they apply to oil and gas-related construction activities. Construction activities associated with oil and gas exploration, production, processing and treatment, and transmission facilities that are defined in the following North American Industrial Classification System (NAICS) codes and titles: 211-Oil and Gas Extraction, 213111-Drilling Oil and Gas Wells, 213112-Support Activities for Oil and Gas Operations, 48611-Pipeline Transportation of Crude Oil and 48621-Pipeline Transportation of Natural Gas, are generally exempt from State NPDES construction requirements. MDEQ strongly encourages voluntary application of construction best management practices in order to minimize the discharge of pollutants in storm water runoff.
