Construction and Building Materials Branch

The Construction and Building Materials Branch of the Environmental Permits Division (EPD) is responsible for processing applications for environmental permits and coverages for facilities that conduct Construction or Building Material related activities based on the applicant's Standard Industrial Classification (SIC) Code.

Specific permits and coverages handled by this branch include Air Construction, Air Operating, Air Title V, Water NPDES, Water Pretreatment, Water State Operating, Multimedia Asphalt Coverage, Water Baseline Industrial Stormwater Coverage, Water Construction Stormwater Coverage, Water Ready Mix Coverage.

The Permit Board on Environmental Quality reissued the statewide Large Construction Storm Water General Permit (MSR10) on January 13, 2017. This permit authorizes the discharge of storm water run-off into waters of the State from construction sites. This general permit replaces the previous Large Construction Storm Water General Permit that expired December 31, 2015. A Re-Coverage Form and Letter of Instruction will be mailed to everyone that holds an active coverage. Coverage recipients wishing to be covered under the reissued general permit must submit a Re-Coverage Form within 45 days of the date of the Letter of Instruction. ACT8, Condition S-2(3) on Page 17 of the statewide Multimedia Hot Mix Asphalt Facility General Permit (MSR70) has been revised to include stack testing protocol language that existed in the previous General Permit but was omitted in the new General Permit during the recent reissuance process. The added permit language requires the coverage recipient to perform stack testing in accordance with EPA Reference Methods 1-5 (40 CFR 60, Appendix A) and the testing procedures in 40 CFR 60.93. In addition, the coverage recipient shall demonstrate compliance with the opacity limitation in accordance with EPA Reference Method 9 and testing procedures in 40 CFR 60.93 and 40 CFR 60.11. This permit authorizes the discharge of storm water run-off into waters of the State and the construction and operation of air emissions equipment from Hot Mix Asphalt facilities in accordance with the provisions of the Mississippi Air and Water Pollution Control Law. This reissuance will allow the continued operation of Hot Mix Asphalt facilities for an additional five-year period. Coverage recipients wishing to be covered under the reissued general permit must submit a Re-coverage Form within 30-days of the date of the Letter of Instruction. The Re-Coverage Form can be found HERE. The Multimedia Hot Mix Asphalt Facility General Permit can be accessed HERE. Affected Hot Mix Asphalt facilities seeking initial coverage may do so by submitting the appropriate documents found in the Hot Mix Asphalt General Permit Forms Package.

This permit authorizes the discharge of process wastewater and storm water run-off into waters of the State and the construction and operation of air emissions equipment from Ready-Mix concrete facilities in accordance with the provisions of the Mississippi Air and Water Pollution Control Law. This reissuance will allow the continued operation of Ready-Mix Concrete facilities for an additional five-year period. Coverage recipients wishing to be covered under the reissued general permit must submit a Re-coverage Form within 30-days of the date of the Letter of Instruction. The Ready-Mix Concrete General Permit can be accessed HERE. Affected Ready-Mix Concrete facilities seeking initial coverage may do so by submitting the appropriate documents found in the Ready-Mix Concrete General Permit Forms Package.

MDEQ will follow the federal storm water regulations as they apply to oil and gas-related construction activities. Construction activities associated with oil and gas exploration, production, processing and treatment, and transmission facilities that are defined in the following North American Industrial Classification System (NAICS) codes and titles: 211-Oil and Gas Extraction, 213111-Drilling Oil and Gas Wells, 213112-Support Activities for Oil and Gas Operations, 48611-Pipeline Transportation of Crude Oil and 48621-Pipeline Transportation of Natural Gas, are generally exempt from State NPDES construction requirements. MDEQ strongly encourages voluntary application of construction best management practices in order to minimize the discharge of pollutants in storm water runoff. MDEQ has added a link to a form entitled "Coastal County Utility Authority Environmental Clearance Form to the Office of Pollution Control" under commonly used applications and forms. This form is required to be completed and submitted to MDEQ for all construction stormwater coverages in Hancock, Harrison, Jackson, Pearl River and Stone Counties.
