REGULATION APC-S-2:
PERMIT REGULATION FOR THE CONSTRUCTION AND/OR
OPERATION OF AIR EMISSIONS EQUIPMENT

I. GENERAL REQUIREMENTS

A. Replacement of Previous Regulation.
B. Regulation APC-S-5, "Regulations for the Prevention of Significant Deterioration of Air Quality", amended by the Commission on the date of this regulation amendment, provides in Section 2. thereof for the adoption of 40 CFR 52.21 as amended and promulgated by July 1, 2004 as official Regulations of the State of Mississippi except for the exclusions and changes set forth in Sections 2. and 3. of Regulation APC-S-5. Therefore, the definitions set forth in 40 CFR 52.21(b), including the definitions of "emissions unit", "major stationary source", "major modification", and "net emissions increase" as used in this Regulation APC-S-2 are incorporated by reference and shall have the same definition in this Regulation, except for the exclusions and changes set forth in Sections 2. and 3. of Regulation APC-S-5 and except for changes noted herein. C. Definitions

(a) a major modification;

(b) a moderate modification;

(c) a modification involving Anetting@ out of PSD;

(d) a modification involving medical waste incineration or hazardous waste incineration;

(e) a modification meeting the definition of Aconstructing or reconstructing a major source of hazardous air pollutants@ in Commission AAir Toxics Regulations,@ APC-S-8, and 40 CFR, Part 63, Subpart B and thereby requiring a case-by-case Maximum Achievable Control Technology (MACT) determination.
